Riddled With Reversible Errors
As an attorney of four decades, the trial of Trump in New York is riddled with reversible errors, but it will take the U.S. Supreme Court to rectify those wrongs as many of the judges in N.Y., even the appellate judges, are rank liberals and leftists. The only justice you get out of the Left is censure if you are lucky, or imprisonment and death at the other extreme, which is becoming closer and closer to reality today, given the fact that liberalism and the Left are the on-ramps to totalitarianism. I’ve litigated too many cases and been in the appellate process way too many times not to know how political some courts can be in denying justice to those before them.
Folks, you must understand the mindset of a liberal and leftist. They are lawless. They will not follow the written law. They make up the law to conform to their prejudices. Don’t believe me? Ask those in Russia, China, and North Korea, all run by the same toxic mindset as the Left in this country.
For example, you will never get justice or fair treatment from the Left. They are incapable of it. You only need to look to the 9th Circuit U.S. Court of Appeals out in California, which has been overturned on appeal by the U.S. Supreme Court more so than any other circuit, as they were and are ideologically driven and at odds with the Constitution. They could care less about the rule of law. They make it up as they go. That’s what liberals and leftists do. They punish you for not thinking like them.
I’m not going to get into the boring details of how erroneous Trump’s trial was mishandled as most of the nation’s legal experts have already analyzed it and agree with near unanimity that there was no crime. The trial was a sham, and as it was conducted, scores of reversible errors were committed. Even some experts on the other side of the political spectrum and one on CNN agreed. If I were to brief this case on appeal, I would need to file at least a 100-page brief that would exceed the typical page limitation of 35 pages, given the numerous errors. The judge was shockingly and transparently biased.
You need to be worried about what has been done to Trump for your own sake. Someday, it might be you. I’ve represented people from all walks of life and differing viewpoints. BUT, when they come into my office, my goal is to make sure that they are treated in accordance with the letter of the law, not my or the judge’s opinion.
Let me warn you. Juries are extremely flawed and biased. Seasoned lawyers know not to trust them. That is why most cases are settled. The jury system is broken, and you cannot trust that justice will be done.
What is important in the Trump matters is the crime of collusion and conflicted interests, not by Trump but by the prosecutor and the judge who worked in tandem with the White House to block Biden’s main opponent. This is clear unlawful interfering with a presidential election to a degree never seen before in this country. You are in grave danger. Not because it is Trump but because if they can do it to him, you have no chance for justice should you find yourself in court. In fact, this started as a slow-moving revolution and insurrection that has picked up steam via the corruption of the judicial system, much like we see in Russia and China.
These are only show trials to confuse and convince the simple-minded that justice was done. Most simpletons in this country believe that a jury’s decision is sacrosanct. No, it is not, and trials get overturned by the bucket loads. But the Democrats and the Left don’t care. They only need the useful idiots to be conned long enough to win the election.
The Jury System Is Broken
In my paper “A Jury of Your Peers? - Are You Kidding!” I explain how the jury system is broken and give examples of how unjust and untrustworthy it is.
Here are some disturbing statistics about juries and it is alarming. The education level of the average juror is at the elementary grade level. Within the first two and a half minutes of opening statements by the attorneys, the jurors have made up their minds and will use the rest of the trial picking out pieces of evidence to justify their initial, uneducated and biased conclusion.
That is a sad state of affairs, but what would you expect from a Godless society?
In a study by Orrick, Herrington & Sutcliffe, LLP, 52% of the public do not have confidence in the justice system. Of jurors, 65% want an emotional connection with the people involved in order to make a decision. Sixty two (62%) percent want to send a message in their verdict and 77% use punitive damages to punish a corporation. The study further found that:
“Today’s jurors reflect our more polarized society - with more firmly held beliefs on politics, social causes, and perceived injustices than in the past. They are also more likely to act on those beliefs by delivering their own sense of justice.”
Notice, the rule of law and basing its application to the facts and evidence doesn’t even seem to register with the jurors today. And if the judge is corrupt then he will be instructing the jury erroneously as did the judge in Trump’s trial.
Let me ask you this: back in the 1800s and early 1900s in the South, when a black person was accused of a crime and was tried by an all-white jury, do you think justice was done? How about when the judge was a member of the KKK? I’m a white attorney, and I would have moved heaven and earth to get any such trial moved to a less biased venue. Well, in the Trump trial, the judge was a Democrat donor whose appointment to this case was under suspicious circumstances. The judge’s daughter works for the Democrat Party, raising tens of millions of dollars for the Democrats over the coordinated court cases against Trump to defeat Trump in November.
Again, folks, this trial is not about Trump. It is about you! If you are of the wrong faith, political party or ethnicity, justice is going to be hard to find, if at all. I always disabuse my clients not to expect justice. It is rarely found. What you should be worried about is what this trial says about the health of our nation. Everything is political today, and I have firsthand knowledge and experience with the politics within the judicial system, some of which I cannot talk about, but I have lived it. It is sickening.
My cure would be for juries to truly be juries of your peers. The word “peer” means equal. If you are a doctor, then it has to be a jury of doctors. If you are an engineer, then it must be a jury of engineers that understands engineering terms and issues, or if of bankers and financiers, then a jury made up of their equals.
In the situation of a judge, if there are conflicting interests, such as those in the Trump case, it should not have been left to the judge to recuse himself. A judicial panel should have been mandated to remove the judge. Furthermore, the trial should have never been venued in New York. Recusal and change of venue should be mandatory. If the issue is one of complicated financial matters, then it should be a judge well acquainted with such things. Or if it is a corporate matter, then it should be a judge who is well-versed and experienced in the corporate world. You do not hire the fox to guard the henhouse, which is what we saw in the Trump case. No justice was done.
Judicial System In Collapse
Only a moron would believe that Trump got a fair trial or could get a fair trial in New York. In fact, there was no specified crime. All the trials Trump faces were regarding allegations that are years old but were only brought before an election to influence the election. This is collusion and conspiracy. Such trials should be banned when they are clearly being brought to influence an election or are likely to do so.
Look at the bimbos that erupted with Clinton and Trump. No self-respecting woman would bring such claims years and decades after the alleged event. If it was that important, then the claim must be made immediately. In Trump’s case, there was no evidence of an assault. There were no witnesses, and those who testified circumstantially lacked credible memory of the claimed incident—but again, here we are in New York. If I were a corporate counsel for a New York company, I would advise moving the headquarters out of the state. Some already have. Their company and stockholders are at risk of a corrupt judicial system, and corporations are always targets.
Personally, I’m tired of the types of cases where women are allowed to make claims of sexual harassment years and decades after the alleged event, particularly when the target has now become well-known. They are gold diggers or spurned revenge seekers wanting to exact a penalty because they were rejected. And when the target is well known the accuser can make a lot of money from people and media willing to pay for the story and an exclusive.
As Dr. Jordan Peterson has addressed in his lectures, women don’t just fight unfairly; they are malicious. He gives the example of how, when men have differences with each other, they duke it out with their fists, and it is over. But since women can’t do that, they use reputation destruction to get back or get even—and, with them, it is never over. They always feel justified. This is where they are very untrustworthy and unreliable. But in today’s world, the Left has given women victim status.
Having practiced hundreds of domestic and divorce cases, women misuse the Emergency Protective Order (EPO) process to influence the court against the other spouse. The next trick is to call Child Protective Services (CPS) to gain an advantage over the husband in custody battles by trying to influence the judge. It is disgusting. The judicial system is fraught with problems, and not just mildly so. I would say it is in a state of collapse.
The judicial system is also its own worst enemy. Justice is slow and delayed, thus effectively denied. Judges fear making decisions on some political cases for fear of retribution at the ballot box. Or, like here in Louisville, where there is a growing South American gang presence, some judges are reportedly fearful of exacting sentencing for fear of their families. Also, victims now face prosecutions for exercising their right to self-defense, as we saw on the subways of New York. Political persecutions are taking place now by judges who are acting more like political operatives than judges, and where lady justice is not blind.
In Trump’s case, the odds are against him getting a fair appellate hearing at the appeals level in the New York courts. The judges in New York, for the most part, are political activists and operatives. They will rule in accordance with what is in their own personal best interests. The only hope for Trump is to get his matters before a panel of federal judges and/or the U.S. Supreme Court. I believe that Mark Levine has the correct answer. Go straight to the Supreme Court. There is nothing more important than the election of a president. If they can’t muster up the courage to do that, then they, the Supreme Court, have become irrelevant.
The judicial system in this country is corrupt, and there is no impartiality. There is no rule of law anymore. I would love to be a judge in many instances as I know I could be a fair and impartial one, despite my strong political views, simply because I believe in the rule of law, and my moral code as Christianity demands it. You see, there are eternal consequences for Christians, which consequences keep us on the straight and narrow. Now, is it perfect? Nothing is perfect, but it is far, far better and more reliable. I know I could give a liberal a fair trial as much as I disagree with them because my focus is on doing what is right and applying the letter of the law, not my feelings about it, and I’ve proven it time and time again.
Years ago, as the Chairman of the Republican Party in Lousiville, Kentucky, I asked the first Republican governor in nearly 40 years to step aside for re-election due to his ineptness and cascading failures while in office. In a long discussion with him, I exposed all his failures, to which I was shocked when he agreed. I asked him what his plan was. Shockingly, he had no plan. My decision was unpopular amongst some of my peers, but I was later proven correct. I’ve had other incidences since then and have the label of being an equal opportunity criticizer. And I am.
Suffice it to say, folks, you are in grave danger from what happened to Trump, and you need to pray for quick intervention. Again, it is really not about him but you. You have lost the trust, as you should, in the judicial system in this country, and it must be restored quickly by reforming the system and removing the bad actors who do not belong there.
